JOINT CUSTODY GUIDANCE IN NWA

The Court, in most cases, will not order joint custody unless the parties mutually agree to the arrangement. If a child custody determination is being decided by the Court, the Court will grant one party the custodial parent and the other party as the non-custodial parent. The non-custodial parent will have reasonable rights of visitation and will pay child support. 

The Court in rare cases can make a determination that joint custody is in the child’s best interest if the parties had been following a joint custody arrangement and it was working well. This is a small exception where the parties have been separated for a substantial period of time prior to a custody determination. Again, the general rule is the parties must mutually agree to joint custody before the Court will accept it.
